On patent application of animal testing methods

Abstract

To determine whether an animal testing methods has practical use, we analyze the relevant provisions on the practicability of China. By analyzing four typical cases we depict the kind of methods belonging to non-therapeutic surgical methods and having practical use, and summarize the criterion for judgement of this kind of methods. We also put forward suggestions to claim rights. When writing the patent application for the animal test method, we should pay attention to the purpose of the method and whether the method contains surgical procedures, and adopt different writing strategies according to the different situations of the method.
