Abstract

With the innovation and application of emerging information technology, as well as data becoming the mainproduction factor, the ethical risks of information privacy personality rights and property rights infringements are increasing.Following the opinions of making institutional regulations and guarantees as the main means of ethical governance of science andtechnology within "The Opinions on Strengthening Ethical Governance of Science and Technology", in terms of institutionalregulations for ethical risks of information privacy personality rights infringements, new systems such as the system of personalinformation identity control rights, the systematic protection system that combines public law and private law, and theprofessional qualification restriction and prohibition system of big data processing business containing sensitive personalinformation were discussed; in terms of institutional regulations for ethical risks of information privacy property rightsinfringements, firstly, the economic rationality of establishing the personal information property rights system was demonstrated,secondly, the nature and rights system of personal information property rights were discussed, finally, three new systems wereelaborated to regulate the ethical risks of information privacy property rights infringements, namely, the personal informationlicensing and processing contract system, the personal information protection fund system and the collective management systemof personal information.
